Dallas Arbor Care - Service Agreement

Terms of Service

Section 1 – General Provisions.

  1. For the purpose of this subsection, the following terms will mean:

(1)  Dallas Arbor Care – The contracted company appointed to fulfill stated or described tree services.

(2)  Customer – Homeowner, commercial entity,  property owner, or representative of listed property or properties mentioned at the end of this document under Customer Information/Contact

(3)  Job Site – Address or Addresses of Customer requested tree service.

B.Changes to the tree service contract are not valid unless agreed to in writing by the customer and Dallas Arbor Care.

C. Customer agrees to charges outlined and agreed to by the services assigned total including Texas State sales tax.

(1) Hourly labor charges or cash discounts are not recognized under this contract and will not be included or considered under  contract agreement.

D. Tree Service contracts must comply with all other applicable laws of the State of Texas.

II. Section 2 – Tree Trimming and Tree Removal Provisions.

  1. The customer is liable for any and all loss, anguish, or damage caused by tree trimming or tree removal, except as listed in subparagraphs (B) and (C).
  2. Above Ground Irrigation (Sprinkler Heads, Caps, and Drains) will be considered repairable if it is found that directly related to tree service work the sprinkler head, cap, or drain was damaged.
  3. Visible damage directly related to tree service work. Claims must be made within 24hrs. of service completion.
  4. Non-visible damage will not be considered repairable/replaceable by this contract.
  5. Underground Installations such as irrigation systems, utilities, and wiring are not deemed repairable by this contract. It is the customers responsibility to provide blueprints or request locate services prior to tree trimming or tree removal service. The State of Texas provides free locate services through Texas811.
  6. Lot Lines and Property Boundries or solely the responsibility of the customer. Dallas Arbor Care will not be responsible for any tree service provided that would find itself in dispute of job site boundries.
  7. Tree removal and tree trimming  prices include the haul away of all large brush, unless otherwise defined by the customer. Sawdust and smaller particle matter, such as, twigs, leafs, and dust may still be apparent after completion of work.
  8. Customers with swimming pools will be responsible for pool care and cleaning after tree services have been completed.
  9. The customer will hold Dallas Arbor Care harmless of any and all future matters of health as it pertains to serviced trees.
  10. Tree removal is not stump grinding, nor, does it define or include stump removal of any kind.
  11. Trees will be trimmed to ISA (International Society of Arboriculture) standards unless, otherwise, defined by the customer in writing.
  12. Mistletoe will be removed to the best of our abilities. This does not mean that all mistletoe will be removed. Future mistletoe growth should be expected.

III. Section 3 – Stump Grinding

  1. Stump Grinding, defined by this contract is an aggressive procedure that shaves ÒgrindsÓ a stump down 6Ó-8Ó below grade allowing for backfill or  mulch settlement. Stump grinding is a separate procedure from tree removal and may be requested along with tree removal or as a separate service.
  2. Unless requested mulch will be left at job site after stump grinding has occurred.

(1)  Mulch left at job site will be raked into a pile. This pile will stand directly on top of where the previous stump was located allowing (in time) mulch to settle into the dug hole

(2)  Dallas Arbor Care does not provide backfill services on stump grinding.

  1. Mulch may be hauled away at customers request for an additional fee.
  2.  Stumps that pose logistical risks due to location or surrounding impediments may not be able to be ground. If impediment can be moved, cleared, or freed from from location it will be the customers responsible to do so before grinding.

  1. Stumps in raised flowerbeds will incur additional costs for grinding.

(1)  Stumps in raised beds will not always allow for grinding 6Ó-8Ó below grade. It is more common that stumps in raised beds will be ground 3Ó-5Ó below topsoil fill.

  1. Stumps may be ground 10Ó-12Ó below grade if  logistics allow, and will be charged additional costs if requested by the customer.

VI. Section 4 – Payment Provisions

  1. PAYMENT IS DUE ON COMPLETION OF ALL AGREED SERVICES. Payment not made on completion of  all services will result in a 2% late fee which will be incurred after the first 7 days from completed work. Payments not made after 30 days will receive an additional 3% late penalty. The customer will be responsible for all Attorney fees and court costs if invoice is not paid. Any services added or deducted from this agreement will be made in writing and total cost will reflect changes made to listed proposal.
  2. If customer is not present at time of services Dallas Arbor Care accepts all major credit cards and payment can be made through our main website at: www.DallasTrees.com or by leaving a check at job site for pick-up.
  3. Checks returned with insufficient funds will be charged a penalty fee of $35.00

(1)  Customers whose checks do not clear will also be charged the late penalty fee of 5% of job costs and subject to legal action.

 

I, customer, have read and understand the above provisions. I accept and agree to the service terms of this electronic document in it's entirety. Services agreed upon with Dallas Arbor Care representatives over the phone or in person will be executed to described completion and payment will be made in full after all services have been rendered.
